PRIVACY POLICY

Effective date: June 1, 2022.

This Privacy Policy (hereinafter – the “Policy”) regulates relations in the field of protection of personal data of visitors to the website https://ptahy.vidchui.org/ (hereinafter – the “Website”), which belongs to the CHARITABLE ORGANIZATION ” CHARITABLE FOUNDATION “FEEL” (EDRPOU code 39440912, address: Ukraine, 03006, Kyiv, Prospekt Akademika Hlushakov, building 1, Pavilion 60), registered in accordance with the current legislation of Ukraine (hereinafter referred to as the “Fund”).

TERMS.
1.1. In this Policy, the following terms are used:

personal data base – a named set of ordered personal data in
in electronic form and/or in the form of personal data files;

consent of the subject of personal data – voluntary expression of will of a natural person (according to
the conditions of her awareness) regarding the granting of permission for the processing of her personal data in accordance with the stated purpose of their processing, expressed in a form that makes it possible to conclude that consent has been given;

processing of personal data – any action or set of actions, such as collection, registration, accumulation, storage, adaptation, change, renewal, use and distribution (distribution, implementation, transfer), depersonalization, destruction of personal data, including using information (automated) systems;
personal data – information or a set of information about a natural person who is identified or can be specifically identified;
subject of personal data – a natural person whose personal data is processed;
third party – any person, with the exception of the subject of personal data, the owner or
manager of personal data;

All other terms in the Policy are used in the meaning defined by the current legislation of Ukraine, including international legal acts ratified in Ukraine.
1.2. This Policy is designed to inform personal data subjects about the procedure for processing their personal data when visiting/using the Website, as well as to ensure the protection of their personal data during such processing.

1.3. This Policy, as well as the Fund’s activities related to the collection, processing, storage and other lawful actions regarding personal data, are regulated by:
• the Constitution of Ukraine;
• Law of Ukraine “On Protection of Personal Data” dated June 1, 2010 No. 2287-VI;

other current normative legal acts of Ukraine, which regulate the issue of personal data protection;
• international legal acts ratified in Ukraine.
The law (including international), national and international legal acts governing the protection of personal data of residents of such countries also applies to legal relations that arise in the Fund in connection with the processing of personal data of residents of foreign jurisdictions.
1.4. The owner of personal data processed in connection with visiting/using the Website options is the Foundation. The Foundation has the right to fully or partially entrust the processing of personal data to third parties on the basis of a contract concluded in accordance with the requirements of current legislation.

1.5. A natural person is a subject of personal data according to this Policy, if he is a visitor to the Website, including if she uses any of the options available on the Website. 1.6. The fund guarantees that:

adheres to good practice and regulatory requirements for the protection of personal data;
protects the rights of personal data subjects;
prevents the risk of violation of the security of personal data processing.
1.7. The purpose of processing personal data obtained during the functioning of the Website is the implementation of the Foundation’s statutory activities.
1.8. Posting this Policy using the link specified in clause 4.1. of this Policy, is a notification to the subjects of personal data about the Owner, the composition and content of personal data collected in connection with visiting/using the Website, about the rights of such subjects, the purpose of collecting their personal data and third parties who such personal data may be transferred.

PERSONAL DATA PROCESSING.
2.1. The Foundation may collect and process the following information about you:

information that you provide to the Foundation: this is information about you that you provide by:
using the Website and Website options, signing up to receive email updates, providing charitable assistance (donations) using the Website options, communicating with the Foundation through the options available on the Website, etc.;

2.2. How the Foundation processes your personal data depends on how you use and interact with the Website. Some of the information may be provided directly by you while using the Website or in another way; other information may be collected and processed by the Fund independently using automated technologies used on the Website.

2.3. Legal grounds for data processing: when visiting the Website, the Foundation processes your personal data,
if 1) the Fund has received your consent to such processing, 2) your personal data is necessary for the Fund to conclude and execute a transaction with you or to take steps prior to concluding a transaction, 3) in cases where the Fund has a legitimate interest in processing your personal data , and this legitimate interest does not override your interests in data protection or your fundamental rights and freedoms, and 4) in other cases determined by applicable law. In some cases, the Foundation may have a legal obligation to process your personal data or will process your personal data to establish, exercise or defend legal claims.

2.4. Automated processing mechanisms: The Foundation and third parties may use automated information processing technologies to process information in some sections of the Website. personal database. The storage of your personal data is carried out in compliance with the requirements of current legislation in the field of personal data.
2.7. The distribution of your personal data is carried out exclusively with your consent or in the cases specified by this Policy and current legislation.

2.8. The Foundation may partially publish user data on its Website under Reporting, Revenue.
2.9. Your personal data is subject to deletion or destruction in case of:

the end of the 2-year period of their storage or another period determined by the current legislation;
termination of the legal relationship between the subject of personal data and the Fund, if otherwise provided by law;
in other cases determined by current legislation in the field of personal data protection.

The Foundation does not process personal data on racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, criminal convictions, as well as data related to health, sexual life, biometric or genetic data, except for the cases specified by law.

RIGHTS OF PERSONAL DATA SUBJECTS.
3.1. When visiting/using the Website, you have the right to:

receive from the Fund information not specified in this Policy regarding processing, conditions
providing access to your personal data, or giving an appropriate mandate to receive this information by persons authorized by you, except for cases specified by law;

for free access to your personal data;
receive an answer to the request regarding the processing of your personal data in the order and c
the term determined by the current legislation;

submit a reasoned claim with an objection to the processing of your personal data
data, or regarding the modification or destruction of your personal data, if such data

are processed illegally or are unreliable;

to protect your personal data from illegal processing and accidental loss,
destruction, damage in connection with intentional concealment, failure to provide or untimely provision of them, as well as to protect against the provision of information that is unreliable or disgraces the honor, dignity and business reputation of a natural person;

withdraw your consent to the processing of personal data;
and also exercise other rights defined by current legislation in the field of personal data protection.
